Personal Information Via.com Collects

Via.com collects the following types of personal information:

• Information You Provide

Via.com collects personal information you provide us, which may include: (i) contact information, such as your name, company name, job title, address, e-mail address, and phone number; (ii) additional information about you to help us get to know you better, such as your gender, age, date of birth, nationality, professional associations and registration numbers, information about how you use our products, and demographic information; (iii) comments, questions, requests and orders you may make; (iv) financial information needed to process payments if you make purchases, such as credit card or account information or tax identification number; (v) log-in information, including, if applicable, social media account information for login purposes; and (vi) information about your preferences, such as your preferred methods of communication and product types in which you are interested.

• Information Automatically Gathered from Your Device

Device and browser information. Via.com may collect technical information about your device, such as device type, browser type, IP address, operating system, and device identifier. Via.com collects this information automatically from your device and web browser through cookies and similar technologies.

Information about how you interact with us. Via.com may collect technical data about your usage of Via.com Internet Sites and Apps and how you interact with our digital advertisements and promotions, such as content viewed or downloaded, features used, links clicked, promotional emails opened, and dates and times of interactions. Via.com collects this information using cookies and similar technologies.

Location information. Via.com may collect location information, including precise real-time location information from your device and imprecise location information derived from, for example, your IP address or postal code. Via.com Apps will NOT access precise-real time location information from your device unless you grant permission to do so.

We use personal information to provide the services you request. To the extent we use your personal information to market to you, we will provide you the ability to opt-out of such uses. We use your personal information to resolve disputes; troubleshoot problems; help promote a safe service; collect fees owed; measure consumer interest in our products and services, inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and as otherwise described to you at the time of collection.

In our efforts to continually improve our product and service offerings, we collect and analyze demographic and profile data about our users' activity on our website.

We identify and use your IP address to help diagnose problems with our server, and to administer our website. Your IP address is also used to help identify you and to gather broad demographic information.

Via.com also uses third-party advertising services to provide advertisements for our products or services that may be of interest to you when you visit websites or other online services.

Via.com allows selected third parties, including these analytics and advertising services, to place cookies on our Internet Sites. These third parties may collect information about your online activities over time and across third-party websites.

These third parties may be members of industry self-regulatory groups such as the Network Advertising Initiative (NAI) and Digital Advertising Alliance (DAA). Do Not Track Browser Settings. Some browsers may transmit "Do Not Track" ("DNT") signals to the websites you visit. Because there is no common agreement about how to interpret DNT signals, Via.com currently does not take action in response to them.

• Information from Business Partners and Agents

Via.com collects personal information through our Business Partners, Agents, and Sub-agents. This information may include contact information, such as name, company name, job title, address, e-mail address, and phone number.

Via.com may also obtain personal information from other third-party sources, including publicly and commercially available sources. We may combine the information we receive from our Business Partners,Agentsand Sub-agents with information that we collect from you or your device, as described above.

You have choices about the personal information you provide Via.com. You may choose not to provide information that we request, but if you do so, we may not be able to provide you a relevant service or a particular feature for a Via.com Internet Site including our products.

Via.com maintains reasonable safeguards to protect the confidentiality, security and integrity of your personal information. Although we use security measures to help protect your personal information against unauthorized disclosure, misuse, or alteration, as is the case with all computer networks linked to the Internet, we cannot guarantee the security of information provided over the Internet and will not be responsible for breaches of security beyond our reasonable control.

Retention of Your Personal Information

How long we keep your personal information will vary and will depend on the purpose and use of information collected. There are legal requirements that we keep some types of data for specific periods. Otherwise, we will retain it for no longer than is necessary for the purposes for which the data was collected.

Children

Most Via.com Internet Sites and Apps are not intended for children under 18 years of age. Via.com will only collect personal information from or about children under 18, or the relevant minimum age under applicable local legal requirements, only for booking transactions or as permitted under applicable law.

Via.com B2B and B2C Services

Some Via.com products, services, Internet Sites, and Apps are intended for use by our Business Partners, including our corporate customers ("Via.com B2B & B2C Services"), and your use of them is administered by your agents, sub-agents, or of your company. Via.com's lawful basis for processing your personal data

• The lawful basis for Via.com's processing of your personal data will depend on the purposes of the processing. For most personal data processing activities covered by this Privacy Policy, the lawful basis is that the processing is necessary for Via.com's legitimate business interests. Via.com reserves the right to update or modify this Policy and any Specific Privacy Statements at any time and without prior notice. The Philippines Addendum to the Via.com Global Privacy Policy

This addendum supplements, details or modifies the Via.com Global Privacy Policy in accordance with the Philippine Data Privacy Act of 2012 (R.A. No. 10173), its implementing rules and regulations and related issuances of the National Privacy Commission (collectively referred to herein as "Law").

This addendum applies to the processing of personal information and sensitive personal information (collectively, "Personal Data") by Via Philippines Travel Corporation ("Via.com" or "we" hereinafter). For this purpose, the term "processing" shall include, but not limited to, the collection, recording, organization, storage, updating or modification, retrieval, consultation, use, consolidation, blocking, erasure or destruction of personal data.

Personal information

Philippine law defines personal information as any information whether recorded in a material form or not, from which the identity of an individual is apparent or can be reasonably and directly ascertained by the entity holding the information, or when put together with other information would directly and certainly identify an individual.

The personal information collected by Via.com may include, but not limited to, the following:

• name, title, address;
• personal identification and/or passport number;
• telephone number;
• email address and online passwords;
• records of communications with Via.com;
• responses to market surveys and contests conducted by Via.com or on its behalf;
• credit card or debit card information;
• camera or video footage that identifies individuals (including CCTV footage) installed at some parts of Via.com's premises as part of its security infrastructure;
• username, password and other identifiers when you register at Via.com's website;

Sensitive personal information

a. Definition of sensitive personal information

Under Philippine law, sensitive personal information refers to personal information:
(1) About an individual's race, ethnic origin, marital status, age, color, and religious, philosophical or political affiliations;
(2) About an individual's health, education, genetic or sexual life of a person, or to any proceeding for any offense committed or alleged to have been committed by such person, the disposal of such proceedings, or the sentence of any court in such proceedings;
(3) Issued by government agencies peculiar to an individual which includes, but not limited to, social security numbers, previous or current health records, licenses or its denials, suspension or revocation, and tax returns; and
(4) Specifically established by an executive order or an act of Congress to be kept classified.

b. Processing of sensitive personal information

We will only process sensitive personal information upon the express consent of the data subject and only for purposes it was provided, or in accordance with law.
In processing sensitive personal information, Via.com will inform data subjects of the sensitive personal information that is necessary to fulfill the core functionality of the product or service, and
the consequences of refusal to the processing, for the purpose of allowing the data subjects to decide whether or not to give consent.

Collection, Purpose of Collection and Processing of Personal Data

Personal data will, generally, only be collected and used for the primary purposes of:

• communicating with employees, customers, contractors, suppliers, agents or any other individuals;
• conducting, improving, maintaining and developing a business relationship and/or for employment purposes;
• general HR administration and information required for the management of the employment relationship;

Disclosure

Via.Com discloses personal data:

• for the primary purpose for which it was collected; or
• for purposes that a reasonable person will consider appropriate in the circumstances; or
• where the individual has consented; or
• for direct marketing by Via.com where consent has been given, but individuals will be given the opportunity to opt out of such direct marketing. Via.com includes its contact details in any direct marketing; or
• where permitted by law;
• to Via.com's parent, related, affiliate and/or associate company;
• in any court of law or any relevant party in connection with any claim or legal proceedings, legal firms and/or advisors, debt collection agencies, credit reporting agencies and/or credit providers;
• to any payment agencies including, but not limited to, financial institutions for purposes of maintaining financial records, assessing or verifying credit, and facilitating payment;
• regulatory authorities and enforcement agencies;
• third party service providers, consultants, insurers, underwriters, auditors and advisors as well as their respective agents and/or contractors on a need to know basis; and
• any actual or potential assignee, transferee or acquirer of any of Via.com's business in connection with any corporate exercise.

Via.Com does not disclose your personal data for any secondary purposes unless your consent has been previously obtained in accordance with law.

Via.Com will not sell or license any personal data that it collects from an individual.

In situations where Via.Com processes personal data outside reasonable expectations, Via.com will require your consent prior to processing.

Cross-border disclosure

Any personal data provided to Via.com may be transferred to, stored by or disclosed to an overseas recipient. For example, Via.com may use a server hosted overseas to store data, which may include your personal data.

Your personal data may also be processed by employees or by other third parties operating outside of the Philippines in countries like the United States of America or in the European Union, who work for Via.com, or by the representatives and employees of Via.com's parent company and affiliates.

Via.com will take reasonable steps, in the circumstances, before your personal data is disclosed to an overseas recipient, to ensure that the overseas recipient does not breach privacy laws in relation to your personal data.

Data breach

Where a suspected data breach has occurred, Via.com will act in accordance with its data breach response plan. In the event that Via.com has determined that a data breach has occurred, we will notify the National Privacy Commission and affected data subject (s) in accordance with law.

Anonymity

Via.com gives individuals the option not to identify themselves when dealing with it, where practicable. However, if you do not provide us with the personal data that we request, our ability to handle your inquiry, request, complaint or application may be diminished.

Consent and limitation in the processing of personal data

You may choose whether or not to provide your personal data, and, if already provided, you may choose to exercise your right to object, block, or remove such personal data as provided by law.
